District and Sessions Court at Gangtok on Friday has sentenced murder convict Dorji Thinley Bhutia, resident of Tathangchen, to a life imprisonment with additional fines.
The accused Dorjee Thinley Bhutia was convicted by Sessions Court on Thursday, May 30, in a case of Dr. Sanjay Upreti’s murder along with attempt to murder a female employee of STNM Hospital case of December 2021.
District and Sessions Court, Special Division 1, Judge Jyoti Khadka pronounced the sentence to the convict under sections 302, 307 and 353 of the Indian Penal Code (IPC), 1860.
The convict has been sentenced to a life imprisonment with Rs 10,000 fine under IPC 302, ten years of imprisonment with Rs. 1,000 fine under IPC 307 and one year imprisonment under IPC 353.
IPC section 302 punishes a convict in case of murder, 307 in case of attempt to murder and 353 for an assault or criminal force to deter the government employee or public servant discharging their duty.
Convict Dorjee Thinley Bhutia on December 14, 2021 had entered into STNM Hospital building and assaulted one female employee. It was reported that the convict had a personal grudge with female victim.
Renowned Cardiologist of the hospital Dr Sanjay Upreti was stabbed while intervening the assault due to which Dr. Upreti’s leg had to be amputated later and unfortunately succumbed to his injuries on December 24, 2021.
“I prayed for imprisonment for life for 302 that too rigorous imprisonment and fine of Rs 50,000 and for 307 i prayed for ten years and fine of Rs 5,000 and for 353 i prayed for one year and fine of Rs 1,000”, said Additional Public Prosecutor Yadhav Sharma while addressing the media.
“I as a Public Prosecutor worked effectively and sincerely to the best of my knowledge due to which I feel justice has been done to the case”, he said.
“He (convict) has a right to file an appeal before the Honorable High Court if he is not satisfied with the judgement passed by this Honourable Court”, said Sharma when asked if the convict could appeal against the judgement in the higher court.
